Petitioner seeks regular bail in a case registered against him under sections 323, 307, 302 (added later on), 120-B, 34 IPC vide FIR No. 0195 dated 13.09.2016 at Police Station Siwani, District Bhiwani on parity with co-accused Sumit and Mannu who have been granted bail by the trial court. Admittedly, statements under section 313 Cr.P.C. have been recorded and trial is at the stage of culmination. It is fixed for defence evidence and arguments today itself. In view of same, the court does not find any ground to release the petitioner on bail. It is inexplicable why co-accused were released on bail at last stage of the trial. Response received from the trial court in this regard pursuant to query dated December 07, 2018 shall be considered administratively.
In answer to the question posed to the State on January 17, 2019, learned State counsel submits that the public prosecutor does not intend to lead any evidence under provisions of section 311 Cr.P.C.
