The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.25 dated 17.5.2018 registered for the offences under Sections 458, 380, 427, 148 and 149 IPC at Police Station Dharamgarh, District Sangrur.
I have heard learned counsel for the petitioner and have gone through the record.
As per the FIR, 348 bags containing 50 kgs. wheat each had been stolen after giving beating to the security guard. A tralla, which was parked in the sheller for loading, was also taken away. The present petitioner is nominated in the present case by the co-accused. He is required for custodial interrogation. Cr. Misc. No.M-48768 of 2018 [2] case, without discussing the facts in minute details and without expressing any opinion on the merits of the case, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
