The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.134 dated 13.9.2016 registered for the offences under Sections 302 and 34 IPC at Police Station Mehtiana, District Hoshiarpur.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner is named in Harpal Singh Parmar 2018.07.23 14:54 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-47881 of 2017 [2] the FIR. Active role is also attributed to him. It is a case of eye witness account. The complainant has not been examined so far. The case is at preliminary stage. There is every chance of tampering with the evidence. Therefore, keeping in view the facts and circumstances of the case, I do not find it a fit case where the petitioner is entitled for the grant of bail.

Hence, finding no merit in this petition, the same is dismissed. July 20, 2018.
