***** ARCHANA PURI, J. (Oral) In consonance with the directions given vide order dated 10.10.2023, intimation was ordered to be given to learned counsel for the appellant, as well as respondent No.3.

Today, learned counsel for respondent No.3-Insurance Company has made appearance. However, none has made appearance on behalf of the appellant, despite the letter having written by the Registry to the counsel. Even, on the last three dates, when the case was dealt by this court, none had made appearance on behalf of the appellant. The appeal in hand had been filed by Jeevan Kumar, appellant, to challenge the recovery rights granted to the Insurance Company. However, none is making appearance to pursue the present appeal. Seemingly, the appellant is not interested to pursue with the present appeal. Hence, the same is hereby dismissed for want of prosecution.
