(Oral) The allegations against the present petitioners Malkiat Singh @ Meeta and Ravinder Singh in this regular bail application are that on 19.10.2014 around 8/9 AM while Joginder Singh complainant was standing outside his house that petitioner Malkiat Singh alias Meeta armed with pistol accompanied by Ravinder Singh who was also armed with pistol along with non-applicant co-acused Vishal Singh came into street and started abusing complainant side. It is alleged that Ravinder Singh petitioner fired a shot in the air and another shot was fired by Vishal Singh leading to the registration of the present case. The contentions of the counsel for the petitioners Mr. Balbir S. Criminal Misc. No. M-7755 of 2015 -2from the alleged place of occurrence and which fact could not be controverted by the State counsel who has rightly conceded to the fact that neither any alleged weapon of offence nor any empties have been recovered from the place of occurrence.
Without going into the merits of the case, in the light of the fact that the petitioners are languishing in jail since 15.11.2014 and investigation and trial is not likely to conclude in the near future, this Court is of the opinion that further detention of the petitioners in the present case is not warranted. Accordingly, they are ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Amritsar.
