RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in case FIR No.0149 dated 11.07.2018 registered under Sections 21, 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 353, 186, 323, 506 and 34 IPC (Section 61/85 of the NDPS Act added later on) at Police Station Chheharrta, District Police Commissionerate, Amritsar. According to the prosecution, on 11.07.2018, co-accused Shashi was apprehended with conscious possession of 260 grams of heroin without any permit or licence, who in his disclosure statement disclosed that he used to supply heroin to the petitioner and two-three other co-accused.
Learned counsel for the petitioner inter alia contends that petitioner has falsely been implicated on the alleged disclosure statement of co-accused Shashi, which is a very weak type of evidence. He is in custody since 21.07.2018. Conclusion of trial may take a sufficient long time. -2CRM-M-48874 of 2018 Co-accused Shubham Mattu, Juna Devi @ Manju, Khushi and Vikramjeet Singh @ Vicky have been granted concession of bail by this Court vide orders dated 24.08.2018, 17.09.2018, 27.09.2018 and 25.10.2018 passed in CRM Nos. M-35803 of 2018, 39352 of 2018, 41773 of 2018 and 45757 of 2018, respectively. Therefore, treating the case of the petitioner on the same parity, he may be granted bail.
On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial on the same parity as that of his co-accused, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
