The present petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing the order dated 25.06.2020 (Annexure P-20) vide which the selection of the petitioner for appointment to the post of LDC with respondents No.2 and 3 has been rejected at Sr.No.90 on the ground that he is not having a valid diploma as well as his non inclusion in the list of selected candidates in the revised result declared on 06.01.2020 (Annexure P-12) 2.

Short reply filed by respondent No.1, is taken on record. 3.

Both learned counsel for the parties are ad idem that the Monika Verma 2024.02.15 22:26 I attest to the accuracy and integrity of this document present petition may be disposed of with a direction to the UHBVNL for taking a

CWP-12203-2020 (O&M) -2final decision on the recommendation made by the Secretary, Haryana Staff Selection Commission to the Managing Director, UHBVNL, Panchkula, vide Annexure P-26 in a time bound manner pertaining to the issue of grant of seniority position to the petitioner.

In view of the joint submission made by all the learned counsel for the parties, this petition is disposed of with a direction to respondent No.3Chief Engineer/Administration, UHBVNL, to take a final decision on the seniority issue of the petitioner in the light of Annexure P-26 and also in the light of any other document or provision of law and strictly in accordance with law within a period of two months from today. Before taking a decision, the Chief Engineer shall afford an opportunity of hearing to the petitioner or his counsel in this regard. 4.

Needless to mention here, if any adverse order is passed, the petitioner shall be at liberty to avail further appropriate remedy in accordance with law.
