The present revision petition has been filed challenging the orders dated 09.01.2019 and 04.03.2022 vide which the application filed by the petitioners under Order 39 Rule 2-A of the Code of Civil Procedure, 1908 has been dismissed.

Learned counsel for the petitioners, at the outset, has stated that the suit for specific performance filed by the petitioners has since been dismissed. However, a decree for recovery has been passed. 3.

Learned counsel for the petitioners on a query by this Court as to whether the dismissal of the suit was on the ground that the property had been alienated, states that the dismissal was on the ground that the descriptions of the property had not matched. 4.

Since the interim order itself has merged with the final order, the petition under Order 39 Rule 2-A of CPC would not be maintainable. In view thereof, the present petition is dismissed as having been rendered infructuous.
