CORAM:
HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI PRESENT: Mr. Aftab Singh Khara, Advocate for the petitioner(s). Mr. Ravi Dutt, DAG, Haryana for respondents No. 1 to 3. **** HARSIMRAN SINGH SETHI , J. (Oral) CM-17173-CWP-2023 in CWP No. 12641-2020 Prayer in the present application is for placing on record Annexure P-15 and P-16 alongwith exemption from filing the affidavit of the applicant as the petitioner is currently playing Asian Games 2023.
-3After going through the averments mentioned in the application, same is allowed. Consequently, Annexure P-15 and Annexure P-16 are ordered to be taken on record.
Application stands disposed of.
Main case(s) 1.
By this common order, above mentioned five writ petitions are being disposed of as all the writ petitions involve the same question of law on similar facts.
2.
Learned counsel for the petitioners submits that the only question of law raised in the present petitions is as to whether the policy which was applicable on the date of submitting the application forms by the petitioners to claim benefit of appointment will be applicable or the subsequent amended policy will be applicable and the said question of law has already been decided by this Court by passing order in CWP-192442019- 'Arvind and others v. State of Haryana and others', decided on 05.09.2023 and the question of law raised in the present petitions is also the same.
3.
Learned State counsel on the other hand submits that the said question is already pending consideration before the Division Bench Court in LPA No. 691 of 2022.
4.
Keeping in view of the fact that a detailed order has already been passed on the same issue as raised in the present petitions, mere the pendecny of the LPA in another case will not take away the right of the petitioners to
-4claim the benefit under the judgment of this Court in CWP-19244-2019 -'Arvind and others v. State of Haryana and others'. . 5.
Further, no LPA has been filed so far against the judgment passed in Arvind's case (Supra), hence, the present petitions are also allowed in the same terms as in CWP-19244-2019- 'Arvind and others v. State of Haryana and others'.
6.
All the writ petitions stand disposed of in above terms. 7.
Civil miscellaneous application pending, if any, is also disposed of 8.
A photocopy of this order be placed on the files of connected cases.
