ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in Criminal Appeal No.347/2017 against the judgment of conviction dated 03.05.2017 passed by the trial Court.

Counsel for the petitioner has submitted that the petitioner, in pursuance to the order dated 15.12.2017, has appeared before the Appellate Court on 19.02.2018 and the matter has been compromised between the parties and in view of the compromised part payment of Rs.1,07,000/- has been paid by the petitioner - Gurbaksh Singh to the complainant and the case is now fixed before the Lok Adalat at Bathinda for 17.03.2018 for making the remaining payment. Counsel for the State has not disputed the factual position, however, opposed the prayer for bail.

In view of the above, the petition is allowed and the interim bail granted to the petitioner vide order dated 15.12.2017 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
