The petitioner prays for grant of regular bail pending trial in a criminal case arising from FIR No. 158 dated 09.08.2019, registered under Section 420, 465, 467, 468, 471 & l20-B IPC at Police Station Sarabha Nagar, District Police Commissionerate, Ludhiana. The FIR has been registered by the official of the Bank of India with the allegations that the petitioner had got financed a second hand car for a sum of 4,30,000/-. However, he did not purchase the vehicle. ₹ Learned counsel for the petitioner contends that the vehicle has been purchased by the petitioner in the name of his real brother, namely Raminder Singh. He further submits that the petitioner is in custody since 26.06.2020.

Criminal Misc. No. M-23428 of 2020 Learned counsel for the respondent also admits that on the completion of the investigation, the challan has been filed in the Court, however, the trial of the case has not started. The conclusion of trial of the case is likely to take time. The case against the petitioner is triable by the Judicial Magistrate Ist Class. Without commenting on the merits of the case, the present petition is allowed and the petitioner is directed to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the learned trial Court/Chief Judicial Magistrate/Duty Magistrate.
