ANIL KSHETARPAL, J(Oral) The petitioner prays for regular bail pending trial in a criminal case arising from FIR No.47, dated 21.04.2022, registered under Sections 304, 337, 338, 427, 279 IPC and Section 185 & 188 of the Motor Vehicles Act, 1988, at Police Station Subhanpur, District Kapurthala, Punjab. As per the case of the prosecution, the petitioner while driving a commercial vehicle came from behind and struck the motorcycle ridden by two persons. He dragged the motorcycle with his vehicle to some distance resulting in the death of Mandeep Singh, whereas, the second person riding on the bike was grievously injured.

The petitioner is stated to be driving under the influence of liquor.

On conclusion of investigation, the Police has already filed a final report before the Court.

The petitioner is in custody since 20.04.2022. Sh. Amit Mehta, Senior Deputy Advocate General, Punjab, on instructions from ASI Rajender Kumar, has stated that the petitioner does not MOHD AYUB 2022.06.09 16:41 I attest to the accuracy and authenticity of this document.

CRM-M-25596-2022 -2have a criminal past. The trial of the case is likely to take a long time. Hence, the petitioner is directed to be released on the regular bail subject to furnishing of adequate surety to the satisfaction of the trial Court/Duty Magistrate.

Accordingly, the petition is allowed with the aforesaid directions.

All the pending miscellaneous applications, if any, are also disposed of.
