This is a petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioner in FIR No.59 dated 03.04.2023 under Section 498-A/406 of the Indian Penal Code, 1860, registered at Police Station City-1 Abohar, District Fazilka. 2.

On 16.05.2023 the following order was passed : "This is a petition under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner in FIR No.59 dated 03.04.2023, under Sections 498-A, 406 of IPC, registered at Police Station City-I Abohar, District Fazilka.

Learned counsel for the petitioner contends that marriage between the parties was solemnized on 17.06.2022 which did not last even for seven days, as

-2the complainant left the matrimonial home within a week of the marriage. Besides, even as per the allegations in the FIR, no dowry was given. The allegations are that after the marriage, the accused and his family members started demanding dowry and harassing the complainant. Therefore, no recovery is to be effected.

Notice of motion.

Mr. Jashandeep Singh, AAG, Punjab, accepts notice on behalf of respondent-State.

Adjourned to 03.10.2023.

In the meanwhile, the petitioner shall join the investigation as and when called upon to do so by the Investigating Officer, and in the event of arrest, he shall be released on interim bail to the satisfaction of Arresting Officer. The petitioner shall also abide by the conditions of Section 438 (2) Cr.P.C."

Learned counsel for the petitioner would contend that pursuant to the said order the petitioner has joined investigation and has fully cooperated.

Learned counsel for the State, on instructions from HC Harsh Kumar has stated that the petitioner has since joined investigation and has fully cooperated and that he is no longer required for further custodial interrogation as of now.

In view of the above, the order dated 16.05.2023 is made

-3absolute. The petitioner shall, however, join investigation as and when called. The petitioner shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973. 6.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
