Petitioners No.2 and 3 are seeking regular bail in FIR No.321 dated 28.07.2016 under Sections 406, 420, 467, 468, 471, 120-B and 506 of Indian Penal Code, 1860 registered at Police Station Model Town Rewari, District Rewari.

Learned counsel for the petitioners No.2 and 3 have submitted that petitioners No.2 and 3 are in custody since 19.01.2018. They have spent more than 02 years behind the bars. Since the trial is yet to be started, they deserve the concession of regular bail.

On instructions from SI Bijender Singh, learned State counsel has submitted that challan in this case was presented on 19.03.2018 and SAVITA KADIAN 2020.02.04 16:30 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-22646 of 2019 {2} charges were framed on 22.05.2018. He has further submitted that the prosecution witnesses could not be examined because of the delaying tactics adopted by the accused.

Heard.

Considering the fact that petitioners No.2 and 3 are in custody for the last more than 02 years and the trial is likely to take substantial time, no useful purpose would be served by keeping them behind the bars any further.

Without commenting anything on the merits of the case, the petition is allowed and petitioners No.2 and 3 are ordered to be released on bail on their furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
