The petitioner was arrested from the spot in a truck, driven by him with 90 kgs of poppy husk and 100 gram of opium. Co-accused of the petitioner, who was not travelling in the truck of the petitioner, has been granted the concession of bail. Counsel for the petitioner has relied upon the said order.
After hearing learned counsel for the petitioner and considering the facts and circumstances of the case, I do not find any ground to grant the concession of bail to the petitioner on account of commercial quantity of poppy husk having been recovered from the truck, driven by him but in the interest of justice, I deem it appropriate to direct the trial court to conclude the trial within a period of six months as the petitioner has been in custody for the last about nine months and no witness has been examined.
The petition is disposed of with a direction to the trial court to conclude the trial within a period of six months, after the next date of hearing fixed before it. In case, for any reason, the entire prosecution evidence is not recorded and the trial is not concluded within six months after the next date of hearing, the trial court shall release the petitioner on bail on his furnishing bail bonds/ surety bonds to its satisfaction.
