(ORAL) This petition has been filed by the petitioner, namely, Kuldeep @ Vicky, under Section 439 Cr.P.C. for grant of regular bail pending trial in criminal case arising from FIR No. 39, dated 22.02.2020, registered under Section 379 IPC and Section 136 of the Indian Electricity Act, 2003 (Section 411 IPC added later on), at Police Station Sadar Kaithal, District Kaithal.

Learned counsel for the petitioner relies upon an order dated 10.08.2020 granting bail to a co-accused in CRM-M-20352-2020 (Kuldeep @ Vicky vs. State of Haryana). He further submits that the petitioner is in custody since 28.02.2020.

The case is triable by Magistrate. The conclusion of the trial is likely to take time.

Without commenting on the merits of the case and keeping in view the order passed on 22.07.2020, the petitioner is directed to be released on regular bail, if not required in any other case, subject to furnishing of adequate surety to the satisfaction of the Chief Judicial

Accordingly, the petition is allowed with the aforesaid directions.
