(Oral) Prayer in the instant petition is made for grant of prearrest bail under Section 438 Cr.P.C. in FIR No. 73 dated 02.06.2014 for offence under Section 420 of Indian Penal Code (IPC), registered at Police Station Maqboolpura, District Amritsar City. The petitioner is alleged to have cheated the complainant to the tune of ` 3,13,524/- for entering into the transaction for the sale deed of the property in the year 2009-10. Both petitioner as well as complainant are the property dealers. The complainant is a retired CDPO. The deals between the parties are oral. The only ground of rejecting the pre-arrest bail by the Sessions Court was that recovery of the amount was to be made.
Learned State counsel on instructions from ASI Baljinder Singh submits that the petitioner has joined the investigation on 11.05.2015 in deference to the order dated 12.3.2015 and is no more required for further investigation.
