(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.66 dated 30.07.2017, under Sections 21, 29, 61, 85 of NDPS Act and Section 3 of the O.S. Act, registered at Police Station Khalra, District Tarn Taran (Punjab). Learned counsel submits that petitioner is incarcerated since 23.09.2017. No recovery has been effected from him. Learned State counsel has opposed the prayer for bail. He, on instructions from H.C. Tarsem Lal, submits that challan is yet to be presented.

Heard.

Keeping in view the period of incarceration of the petitioner, and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioner any longer. Accordingly, petition is allowed and the petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Tarn Taran.
