(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioners in case FIR No.9 dated 05.02.2019 under Sections 304-B, 498A/ 34 IPC registered at Police Station Balianwali, District Bathinda. Learned counsel for the petitioners submits that the petitioners, who are father-in-law and mother-in-law of the deceased Reena Kaur, have joined the investigation and their custodial interrogation is no more required in the case. He submits that Sukhwinder Singh @ Sukhu husband of deceased Reena Kaur has faced the trial in the case on account of commission of suicide by Reena Kaur on 05.02.2019 and he has been acquitted by the trial Court in the present FIR vide judgment dated ASHWANI KUMAR 2019.10.30 18:50 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-22632 of 2019 -201.06.2019. He has produced a photocopy of the judgment dated 01.06.2019 passed by Additional Sessions Judge, Bathinda, acquitting Sukhwinder Singh @ Sukhu, which is taken on record. Learned State counsel, on instructions from HC Gurvinder Singh, does not dispute the aforesaid facts.

I have heard learned counsel for the parties. Considering the fact that the petitioners have joined the investigation and their custodial interrogation is no more required, the present petition is allowed and the interim order dated 17.05.2019 is made absolute.

However, the petitioners shall join the investigation as and when directed by the investigating agency and shall abide by the terms and conditions laid down under Section 438(2) Cr.P.C. October 30, 2019 ( HARI PAL VERMA ) AK JUDGE Whether speaking / reasoned?
