The present writ petition has been filed under Articles 226/227 of the Constitution of India for the issuance of a writ in the nature of Certiorari, for quashing the charge sheet dated 13.09.2024 (Annexure P-4), charge sheet dated 27.01.2025 (Annexure P-7), and the impugned order dated 30.01.2025 (Annexure P-6), issued by the respondents, being contrary to the facts, illegal, arbitrary, without jurisdiction, improper and not sustainable in the eyes of law; and further for issuance of a writ in the nature PARUL VERMA 2026.04.21 14:48 I attest to the accuracy and authenticity of this order/judgment.
of mandamus directing the respondents to release the withheld amount of gratuity and commutation of pension along with interest @ 12% per annum; and also for issuance of a writ in the nature of mandamus, or any other appropriate writ, order or direction, directing the respondents to grant the benefit of ACP to the petitioner, as the petitioner has served the department/Nigam on the post of JE-I for more than 16 years, i.e. from 01.10.2008 to 31.01.2025 till the date of superannuation, during which period neither any promotion nor the benefit of ACP was granted to him. 2.
At this stage, 0earned counsel for the petitioner wishes to withdraw the present petition with liberty to avail alternate remedy, available to him in accordance with law. 3.
In view of the above, the present petition is dismissed as withdrawn with liberty aforesaid.
