!"# $ Allegations against the petitioner Bikramjit Singh in this third petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.14 dated 01.03.2011 registered at Police Station Mehta under Sections 328/34/307 IPC, are that on 01.03.2011 petitioner along with his co:accused/non:applicants had thrown acid on the face of the complainant Harwinder Singh and the petitioner Bikramjit Singh is alleged to have caught hold of the victim to facilitate action of the other co:accused.

The contentions of learned counsel for the petitioner, Mr.S.K. Tripathi, Advocate that the petitioner is in custody for the last four years and four months have been conceded too at the bar by learned State counsel.
Keeping in view that out of the maximum provided sentence of 10 years, the petitioner has already undergone substantive incarceration impels this Court to release him on bail. Accordingly, the petitioner is ordered to be released on regular bail to the satisfaction of trial Court.
