Mr. Rajesh Mehta, Addl. Advocate General, Punjab *** Amol Rattan Singh, J. (Oral) By this petition filed under Section 439 Cr.P.C., the petitioner seeks the concession of 'regular bail'.
Learned counsel for the petitioner submits that the petitioner is in custody for the past 7 months, with even the case not having been committed to the competent Court of jurisdiction as yet. He further submits that though one of the three injuries shown to be inflicted upon the complainant was declared to be dangerous to life, as a matter of fact, the complainant was discharged on the very same date that he had gone to the hospital for his treatment. Learned counsel appearing for the State, on instructions from ASI Gurbax Singh, does not dispute the aforesaid factual position.
Keeping in view the custody period undergone by the petitioner and the stage of the trial, but without making any final comment on the merits of the case, I deem it appropriate to allow the present petition. Consequently, the present petition is allowed. The petitioner would be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
