(ORAL) CRM No.23683 of 2022 This application has been moved on behalf of the applicantpetitioner with a prayer for issuance of fresh notice to appear before learned trial Court in pursuance of the order dated 08.06.2022. However, learned counsel for the applicant-petitioner submits that he intends to withdraw the main petition bearing CRM-M No.26006 of 2022 itself along-with the present application. Learned State counsel has no objection for the same. Accordingly, the instant application stands dismissed for having been withdrawn and the above-said main petition is taken on the Board today itself.

the instant petition while submitting that the petitioner would be surrendering before the trial Court concerned within a period of four days and would be moving an application for seeking the relief of regular bail and he further prays that the trial Court be directed to decide the said bail application within some specific time frame.

Learned State counsel has no objection to the above-discussed submission as well as the prayer as made by learned counsel for the petitioner.

Resultantly, the petition in hand is hereby dismissed for having been withdrawn with the observation that in case, the petitioner surrenders before the concerned trial Court within a period of four days from today and moves the application for seeking the relief of regular bail, the same be decided, in accordance with law, in the given set of facts and circumstances of the case, preferably within two days thereafter.
