LISA GILL, J. (Oral) The petitioner seeks the concession of anticipatory bail in FIR No.101 dated 07.04.2017 under Sections 354-D, 451, 323, 506 IPC registered at Police Station City, Kapurthala, District Kapurthala. It is submitted that the petitioner has been falsely implicated as there was a quarrel between the petitioner and the complainant's husband on 05.04.2017. It is due to this altercation that the present FIR has been lodged with ulterior motive. It is further stated that though it is mentioned in the FIR that the complainant's husband was admitted in the Civil Hospital there is no medical evidence on record to reflect that any injury was ever caused to the complainant. Moreover, the petitioner has joined investigation. He undertakes to face the proceedings and not misuse the concession of anticipatory bail if confirmed. It is, thus, prayed that this petition be allowed.

Crl. Misc. No. M-48139 of 2017 [ 2 ] Singh, verifies that the petitioner has joined investigation and his custodial interrogation is not required. No recovery is to be effected from him. The petitioner is not reported to be involved in any other criminal case. Keeping in view the facts and circumstances of the case but without expressing any opinion on the merits of the case, it is considered just and expedient to allow this petition. Consequently, order dated 22.12.2017 is made absolute.

None of the observations made here-in-above shall be construed to be a reflection on merits of the case and shall have no bearing on trial.
