The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in DDR No.31 dated 29.3.2014 (Annexure-P.1) registered for the offences under Sections 427, 323 and 34 IPC registered at Police Station Kot Dharmu, District Mansa, entered in FIR No.28 dated 31.3.2014 under Sections 452, 323, 148 and 149 IPC. Notice of motion to Advocate General, Punjab. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. A perusal of the record shows that the petitioner absented from HARPAL SINGH PARMAR 2019.05.24 16:53 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-22879 of 2019 [2] the Court proceedings on 7.11.2017 and he was declared as proclaimed offender on 8.1.2018. He could not be arrested till 8.4.2019 and his absence is about 11⁄2 years.
Keeping in view the facts and circumstances of the case and the fact that the petitioner has been in custody since 8.4.2019 and the trial of the case is likely to take long time, no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. However, keeping in view his intentional period of absence, the petitioner is burdened with costs of Rs.20,000/-, to be deposited with District Legal Services Authority, Mansa.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the trial Court/Duty Magistrate subject to his depositing costs of `20,000/- with the District Legal Services Authority, Mansa.
