(ORAL) Instant petition is pending since the year 2014 and the trial is unnecessarily held up on account of stay of the proceedings. Heard.
The matter requires appreciation of evidence. Therefore, impugned complaint (Annexure P-8) cannot be quashed in a petition under Section 482 Cr.P.C. without appreciating the evidence. The trial is at the fag end and thus, would be concluded shortly. Therefore, in the fitness of things, petitioners are relegated to trial court with liberty to raise all the pleas, which have been raised in the instant petition at appropriate stage.
Disposed of as such.
