Mr.Kirat Singh Sidhu,DAG Punjab assisted by Mr.ASI Satbir Singh Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail in case FIR No.124 dated 28.9.2015 under Sections 420/120-B IPC, PS Division no.2, Pathankot.

There are allegations that the petitioner alongwith coaccused Sukhwinder Singh and Shub Kanwar has induced the complainant in making payment of Rs.3.5 lacs for sending the son of the complainant abroad.

It was contended that the petitioner is employed as a Seaman in the Merchant Navy in Malaysia. The entire money was paid to co-accused Sukhwinder Singh and Shub Kanwar through their bank RAJINDER PRASHAD JOSHI 2016.05.07 11:47 I attest to the accuracy and integrity of this document

CRM-M No.6891/2016 accounts. The son of the complainant, in fact, had stayed with the petitioner for almost four months in Malaysia. From the facts cumulatively taken, no offence is made out against the petitioner. Vide order dated 25.2.2016 while granting interim protection,petitioner was directed to join investigation. At the time of hearing today,learned counsel submits that petitioner has joined investigation and fully cooperated with the same. Learned State counsel on instructions is unable to refute the said factual position and further states that custodial interrogation of petitioner is no longer required.

In view of the above,interim bail granted vide order dated 25.2.2016 is made absolute.

Disposed of.
