This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 734 dated 25.08.2017 under sections 147, 149, 188, 427, 435, 120-B IPC, section 3, 4 of Prevention of Damage toPublic Property Act & section 3/4/6 of Explosive Substance Act at Police Station Model Town, Panipat.

Learned State counsel seeks to place on record affidavit of Rajesh Kumar, Dy. Superintendent of Police, City Panipat. Petitioner is stated to be in custody since 02.09.2017. Allegation against the petitioner is that he conspired with other accused which led to setting ablaze four vehicles. In this manner, damage been caused to public property. Admittedly, investigation has been completed and trial is in progress. Thus, no useful purpose would be served by detaining the petitioner in custody during the pendency of trial. Without expressing any opinion on the merits of the case, this court feels that petitioner deserves to be enlarged on bail.
