(ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to grant him all consequential benefits with effect from 15.10.1989 i.e. deemed date of appointment at par with his juniors as per merit determined by Haryana Staff Selection Commission.

Learned counsel for the petitioner submits that juniors to the petitioner have been given the same benefit vide order dated 13.11.2018 (Annexure P-4) and their pay has been re-fixed vide Annexures P-5 to P-7 in compliance of the order dated 17.07.2018 passed by this Court vide CWP No.6875 of 2016 titled as ÒShamsher Singh and others Vs. State of Haryana and othersÓ contained at Annexure P-2. 3.
Learned counsel for the petitioner submits that in the premise, petitioner caused issuance of a legal notice dated 27.04.2021 (Annexure P8), but the same has not been adverted by the respondents till date. Hence, the instant petition.

Learned State counsel, on advance service, joins proceedings and opposes issuance of notice of motion and states that competent authority shall take appropriate decision on the pending legal notice dated 27.04.2021 (Annexure P-8).

At this stage, learned counsel for the petitioner also submits that let a final decision is taken, either way, by the competent authority on the pending legal notice dated 27.04.2021 (Annexure P-8), giving reasons thereof.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per legal notice dated 27.04.2021 (Annexure P8) and also by keeping in view the contentions raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of three months from today.

Disposed of accordingly.
