(ORAL) By way of present petition under Section 482 Cr.P.C. the petitioner prays for quashing of case FIR No.482 dated 12.05.2016 registered under Sections 406 and 420 IPC, P.S.Sadar, District Gurgaon (Gurugram) (P-1) along with all consequential proceedings arising out of the same.

Learned State counsel on instructions from ASI Ajit Kumar, P.S. Sadar, District Gurugram informs that the petitioners have been declared as proclaimed persons vide order dated 01.02.2021 passed by the Court of Ms. Sumitra Kadian, JMIC, Gurugram. He also placed reliance; upon decision dated 24.08.2012 passed in CRM-M-15353 of 2012 titled as "Kuldip Singh and Others versus State of Punjab", so as to contend that the prayer for seeking quashing of the FIR at the instance of an individual who is absconding from the Court proceedings, cannot be entertained.

3. In view of the aforesaid facts since the petitioners already stand declared proclaimed persons vide order dated 01.02.2021 passed by the SHRUTI 2023.05.05 12:30 I attest to the accuracy and integrity of this order/judgment.

CRM-M-49192-2018 -2Court of Ms. Sumitra Kadian, JMIC, Gurugram and no one is appearing on their behalf, the present petition is hereby dismissed. However liberty is granted to the petitioners so as to avail their remedy in accordance with law, challenging the order passed against them whereby they have been declared as proclaimed persons as well as quashing of the FIR.
