(ORAL) Through this petition under Section 482 Cr.P.C., prayer has been made for issuance of direction to respondents No. 1 to 5 to arrest accused in case FIR No. 27 dated 15.02.2015 under Sections 302 and 201 IPC registered at Police Station Chhapar, Distirct Yamuna Nagar. In terms of order dated 01.10.2019, reply by way of affidavit of Sh. Pardeep Kumar, HPS, Deputy Superintendent of Police, Yamuna Nagar has been filed. According to the same, the instant petition has rendered infructuous, in view of filing of untraced report in Court.
In view of the above, the instant petition is dismissed as having been rendered infructuous, with the observation that in case, the petitioner furnishes any fresh convincing clue qua the alleged murder of his brother, restoring the instant petition, police authorities would be directed for re-investigation or in the alternative, petitioner can directly move to the police authorities for re-investigation of the matter.
