RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.70 dated 22.06.2018 registered under Sections 392, 395, 379-B, 457, 380, 411, 482, 148, 149, 400 IPC and Section 25 of the Arms Act, 1959 at Police Station Lambra, District Jalandhar. According to the prosecution, during police custody, on disclosure statement of the petitioner, nine buffaloes were recovered. Learned counsel for the petitioner inter alia contends that no recovery has to be effected from the petitioner. He is in custody since 24.06.2018. Treating the case of the petitioner on the same parity as that of his co-accused namely, Dilbagh Singh, who has been granted regular bail by this Court vide order dated 03.10.2018 passed in CRM-M-42429 of 2018, he may also be enlarged on bail. Conclusion of trial may take a sufficient long time. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case and treating the case of the petitioner on the same parity as that of his co-accused, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
