(Oral) Since both the aforesaid petitions are arising out of one and the same FIR, the same are being disposed of together. The allegations against petitioner Balwinder Kumar @ Pappi and Maninder Pal alias Laddi are that on 20.12.2015 on the basis of secret information against Harbhajan Singh alias Bittu, the present case was registered. Criminal Misc. No. M-6982 of 2016 -2evidence against them except the statement of co-accused, which is conceded by learned State counsel at the bar. Keeping in view that the very effect of section 30 of the Evidence Act can be seen at the time of trial and the petitioners are in custody since 30.12.2015 and 25.12.2015 respectively and the trial is not likely to be concluded in near future and no purpose will be served by detaining the petitioners in jail, both the petitioners namely Maninder Pal alias Laddi and Balwinder Kumar @ Pappi are ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Ferozepur.
