Petitioner seeks concession of bail in a case registered against him vide FIR No. 272 dated 07.12.2014 under sections 22/61/85 NDPS Act at Police Station Division No. 5, Civil Line, District Ludhiana.

Learned counsel for the petitioner contends that quantity of contraband recovered from the petitioner is non-commercial in nature.

Learned State counsel at the outset submits that FSL report has been received. According to same, petitioner is in possession of 20 grams of Heroin.

Keeping in view the fact that contraband recovered from the petitioner is non-commercial in nature; he is in custody since December, 2014 and the fact that trial may take some time to conclude, order dated May 07, 2015 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C. Disposed of.
