Rajan Gupta, J (Oral) This is a petition under Section 439 Cr.P.C. seeking regular bail in a case registered under Sections 364, 120-B, 302, 397 IPC vide FIR No.147 dated 16.7.2013 at Police Station, Mattaur, District, Mohali. Learned State counsel, on instructions from ASI-Surjit Singh, submits that out of 35 witnesses cited by the prosecution, 9 have been given up and 18 have been examined. Prosecution shall make an effort to conclude its evidence at the earliest.
In view of above, no ground is made out for enlarging the petitioner on bail.
Dismissed.
Petitioner shall, however, be at liberty to file a fresh petition in case the trial does not conclude within a period of 5 months. (Rajan Gupta) Judge April 10, 2015 BB
