!"# $ Petitioner Satdev in this petition filed under Section 439 Cr.P.C. is alleged to have been, along with his co1accused, working in PSPCL at a project for construction of grid at Pakhowal Sudhar, however alleged to have embezzled 300 bags of cement. The petitioner at that very time was working as a JE. It is conceded case of the learned State counsel that nothing has been recovered from the possession of the petitioner, except the fact that he was the official to whom the 300 bags of cement were issued by the Stores at Ludhiana. In the light of the submissions of petitioner's counsel that co1accused similarly placed have already been granted bail by this Court vide orders dated 22.01.2015 passed in CRM1M No.42752 of 2014 and in view of the fact that the investigation and so the trial is not likely to conclude in the near future, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of the trial Court.
