Present petition under Section 438 Cr.P.C. for quashing of order dated 02.05.2019, passed by the learned Judge, Special Court, Sangrur in case FIR No. 56 dated 10.10.2018, registered under Section 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Ahmedgarh, District Sangrur, whereby bail bonds of the petitioner were cancelled and he was ordered to be summoned through non-bailable warrants of arrest.
Learned counsel for the petitioner contended that petitioner was earlier admitted to bail and had been regularly appearing before the learned trial Court to face trial, but on 02.05.2019, he could not appear befor the learned trial Judge for certain unavoidable circumstances, though he has no intention to do so. Learned counsel further contended that petitioner undertakes to appear before the learned trial Court regularly to face trial. Notice of motion.

Criminal Misc. No. M-22772 of 2019 On asking of the Court, Mr. Rajat Bansal, Assistant Advocate General, Punjab accepts notice on behalf of respondent. A copy of paperbook be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to bail, the learned trial Judge shall release him on bail on his furnishing fresh bail bonds and surety bonds to his satisfaction. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C.
