******* SURINDER GUPTA, J.(Oral) Learned counsel for petitioners submits that in another FIR bearing no. 29 dated 30.01.2006, registered at Police Station Saraikhawaja, District Faridabad on the complaint of Govind Ram Awana, the matter has already been investigated by the police and petitioners have been challaned. On similar set of allegations, this second FIR has been registered. Learned State counsel submits that FIR registered by Govind Ram Awana was pertaining to different land. Complainant in that case is also one of the accused in present FIR. However, plea being raised by petitioners will be considered during investigation. In view of submission of learned State counsel, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to petitioners to raise pleas taken in this petition before investigating agency and before other legal authorities.
