(Oral) Prayer in the present petition under Section 482 Cr.P.C. is for setting aside order dated 17.12.2022 (Annexure P-11) passed by learned Judicial Magistrate 1st Class, Jalandhar whereby the petitioner was declared as Proclaimed Offender in FIR No. 0053 dated 22.06.2022 (Annexure p-9) under Sections 406/498-A IPC at Police Station Women Police Commissioner, Jalandhar and all other proceedings arising therefrom.
In compliance of last order dated 18.09.2024, payment of costs of Rs.20,000/- has been duly deposited by the petitioner before the Punjab and Haryana High Court Lawyers' Welfare Association Fund, Chandigarh, in respect of which a receipt dated 18.10.2024 has been handed over in Court today and the same is taken on record. Learned counsel for the petitioner submits that the petitioner was unable to surrender before the learned trial Court due to DIVYANSHI 2024.11.06 10:28 I attest to the accuracy and integrity of this document
CRM-43652-2024 in/and CRM-M-24291-2024 - 2medical emergency of her husband in respect of which medical record of the husband of the petitioner has been annexed as Annexure P-2 as per which he is stated to have undergone angiography on 20.09.2024. As the petitioner has been unable to surrender before the learned trial Court despite grant of two effective opportunities by this Court vide orders dated 15.05.2024 and 18.09.2024, learned counsel for the petitioner prays that he may be permitted to withdraw the present petition, at this stage.
Permitted to do so.
Dismissed as withdrawn, at this stage.
