Harbans Singh v. State Of Punjab And Others
CWP-12372-2020
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH.
(111) CWP-12372-2020 Date of Decision: August 20, 2020 Harbans Singh .. Petitioner
Versus
State of Punjab and others .. Respondents (Through video conferencing) CORAM: HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI
Present:
Mr. Sarabjeet Singh Grewal, Advocate, for the petitioner. Mr. Pankaj Gupta, Addl. A.G., Punjab.
HARSIMRAN SINGH SETHI, J.(ORAL) Learned counsel for the petitioner states that the petitioner has been transferred four times within a short spell and the latest transfer is dated 07.08.2020, by which the petitioner has been transferred as a Panchayat Secretary from Mahal Kalan to Pakhowal. Learned counsel for the petitioner further states that the petitioner has already complied with the said order but he fears that he will be again transferred within a short spell. Keeping in view the above assertion, it is clear that the petitioner is only apprehending another transfer whereas, the writ cannot be issued on the basis of the apprehension. In case, the petitioner is again transferred within a short spell, the said action will give a cause of action to the petitioner to approach this Court.
That being so, learned counsel for the petitioner prays that in case the petitioner is transferred again within a short period of time, liberty be given to him to approach this Court and the petitioner does not wish to press this petition any further.
