Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.03 dated 08.02.2018 under Section 21, 29 of the NDPS Act and Section 66D and 66F of the Information Technology Act, registered at Police Station SSOC, Fazilka. Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per prosecution version, a secret information was received that Hansa Singh etc. along with present petitioner are in the business of smuggling heroin and have links with the smugglers in Pakistan and with VINEET GULATI 2018.11.20 13:32 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-49337 of 2018 -2the help of mobile internet, they talk to smugglers and through fencing on the Indo-Pak Border, they bring heroin in the area of Ferozepur. Hansa Singh was apprehended and 2 kgs. of heroin was recovered from him and from another accused Amarjit Singh, 360 grams of powder was recovered. The allegation against the present petitioner is that the recovered heroin was to be supplied to him.
Keeping in view the facts and circumstances of the present case and in view of the fact that petitioner is named in the FIR and serious allegations are levelled against him, I find that no ground is made out for grant of anticipatory bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.
