Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.33 dated 19.03.2019 under Sections 353, 186, 379, 332, 148 and 149 IPC, registered at Police Station Subhanpur, District Kapurthala.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that on the basis of information given by secret informer, police party reached at the house of present petitioner at 1.30 p.m., where, the petitioner along with his brother and another coVINEET GULATI 2019.05.28 13:38 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-22856 of 2019 -2accused confronted the police party. Jinder gave injuries with spade to Prem Singh, accused Kulwinder Singh attacked Prem Singh with stone and present petitioner hit complainant SI Gopi Chand on his back with wooden log. When other police officials reached at the spot, then all the above-said persons ran way from there.
The present petitioner is named in the FIR. He is armed with weapon and injury is also attributed to him. Further, active role has been played by the present petitioner in the occurrence. Keeping in view the facts and circumstances of the present case, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.
Therefore, finding no merit in the present petition, the same is dismissed.
