Petitioner apprehends arrest having been ordered to be summoned under Section 319 Cr.P.C., as additional accused in a case registered at the instance of Harpal Singh on the allegations that the petitioner along with Happy was also present when sum of Rs.16 lacs had been given to Labh Singh by the complainant with false promise to the complainant for a job. The FIR pertains to the year 2011. The petitioner was found innocent during the course of investigation. It does not appear to be a case where custodial interrogation of the petitioner is required for any purpose as dual version qua the involvement of the petitioner has already cropped up. Notice to the Advocate General, Haryana.

CRM-M-7180-2016 (O&M) Counsel for the petitioner submits that the petitioner is ready to appear before the trial Court on next date of hearing i.e. 2.3.2016 The petition is allowed. It is ordered that in case the petitioner appears before the trial Court on 2.3.2016, he shall be released on bail to the satisfaction of the trial Court without prejudice to his legal rights. In case the petitioner puts in appearance on 2.3.2016, he would be granted the concession of bail subject to the condition that he will not take any steps to tamper with the evidence or delay the proceedings by absenting without sufficient cause.
