MADAAN Present:- Mr. Satwinder Goyal, Advocate for the petitioners. *** Though the trial Court had granted ad-interim injunction to the plaintiff restraining the defendant from creating nuisance in the neighboring plot, however, on an appeal having been filed the order had been set aside for the reason that proceedings under Section 133 Cr.P.C. are pending before SDM, Tapa. Of course, the plaintiff should avail of equally efficacious remedy. Learned counsel for the petitioners has contended that proceedings before SDM, Tapa are going on and have not been concluded so far.
The revision petition is disposed of directing SDM, Tapa to dispose of the application under Section 133 Cr.P.C. moved by petitioners promptly preferably within a period of three months from today.
