(ORAL) Through this petition, the petitioner seeks regular bail in case bearing FIR No.228 dated 17.05.2021 registered under Section 20 of Narcotics Drugs and Psychotropic Substances Act, 1985, Section 188 of IPC and Section 51 of Disaster Management Act, 2005 at Police Station Narnaund, District Hansi.

Learned counsel for the petitioner states that the petitioner is not named in the FIR and has been inducted in the present case on the basis of disclosure statement of the co-accused Rajbir and has been in custody since 28.05.2021. He further states that even the co-accused-Rajbir was not present in his house when the recovery was effected.

Learned counsel for the State while opposing the prayer of the petitioner for grant of bail, has stated that the recovery effected from the petitioner and the co-accused is a huge recovery and the prosecution witnesses are yet to be examined.

I have heard the learned counsel for the parties. No recovery has been effected from the petitioner rather it has been effected from the house of the co-accused even in his absence. Petitioner has been in custody since 28.05.2021. Prosecution witnesses are yet to be examined. The trial is unlikely to conclude any time soon. Therefore, no useful purpose would be served by keeping the petitioner behind the bars. In view of the above, without commenting anything on the merits, lest it should prejudice the case of either side, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
