MANJARI NEHRU KAUL, J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.108 dated 01.06.2020 under Section 61 of the Excise Act, 1914 registered at Police Station Khilchian, Amritsar. Notice of motion.

On the asking of the Court, Ms. Samina Dhir, DAG, Punjab, accepts notice on behalf of the State. She, on instructions, from ASI Shamsher Singh, has apprised this Court that subsequent to the registration of the FIR in question, the petitioner was involved under Section 61 of the Excise Act in another case. In the circumstances, prima facie the petitioner seems to be a habitual offender. Hence, the concession of anticipatory bail cannot be extended to him.

The petition is dismissed.
