On 10.08.2021, the following order was passed:- This is the wife's petition, filed under Section 24 of the Code of Civil Procedure, 1908, seeking the transfer of the petition filed under Section 9 of the Hindu Marriage Act, 1955, titled as "Amandeep Rana vs. Neha Rana" pending in the Court of Additional District Judge, Family Court, Hoshiarpur, to the court of competent jurisdiction at SAS Nagar, Mohali. The petitioner claims that she was married to the respondent on 03.03.2016 and they were blessed with a male child, who is 4 years old. She claims that, at present, she is residing with her aged parents at SAS Nagar, Mohali and is unable to defend the petition at Hoshiarpur.

The liberty is granted to the petitioner to serve the respondent through his counsel Sh. Sharanjit Singh, Advocate, at Hoshiarpur.

Learned counsel representing the respondent submits that the petitioner is working as a Nurse in Max Hospital, Mohali. He submitted that ASHOK KUMAR 2021.08.24 13:37 I attest to the accuracy and integrity of this document

TA-627-2021 (O&M) the distance between the two places is hardly 130kms. It is not in dispute that the petitioner apart from maintaining their four year child is also working at Max Hospital, Mohali. The respondent is able bodied and can travel easily.

Keeping in view the aforesaid facts, the petition is allowed. The file of HMA/210/2021 (Amandeep Rana Vs. Neha Rana) pending in the Court of the Principal Judge, Family Court, Hoshiarpur, is ordered to be transferred to the Court of competent jurisdiction at SAS Nagar, Mohali. The transferor Court is requested to remit the case file to the transferee Court forthwith. The petitioner is directed to appear before the District Judge, Mohali, on 07.09.2021 who will either decide the matter himself or assign it to the Court of competent jurisdiction at SAS Nagar, Mohali. All the pending miscellaneous applications, if any, are also disposed of.
