On the instructions of ASI Inderpal Singh, it has been informed that the petitioner has joined the investigation and that the injuries attributed to the petitioner are simple. The petitioner with the aid of Section 149 IPC is alleged to be liable for the grievous injury attributed to Manoj with a datar on the right arm of the complainant. The petitioner having joined the investigation, it does not appear to be a case of custodial interrogation. The petition is allowed. Interim order dated 29.2.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C. with an additional condition that the petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial.
