The present petition has been filed under Section 482 Cr.P.C. for quashing of Criminal Complaint No.COMI/20/2014, DOI 23.04.2014, registered under Sections 452, 447, 427, 323, 324 and 120-B IPC and the entire consequential proceedings arising thereof and pending before the learned JMIC, Kapurthala including the summoning order dated 17.11.2016. 2.
After arguing for some time, learned counsel for the petitioners prays for withdrawal of the instant petition with liberty to raise all pleas before the trial Court at the appropriate stage. He however, prays that the trial Court be directed to grant exemption to the petitioners from personal appearance as petitioner No.1 is 80 years old while others are also senior citizens. They are ready to furnish an undertaking by way of affidavit to appear before the trial Court on the dates, for which their presence is absolutely necessary. 3.
