(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner - Deepak - in case FIR No.416 dated 01.12.2017 registered under Sections 323, 506 and 34 IPC at Police Station Sector 56, Gurugram, District Gurugram. According to the prosecution, at 9.00 a.m. on 01.12.2017 petitioner along with his accomplice boarded e-rikhaw of the complainant to go to HUDA market and on the way gave beatings to the complainant. Learned counsel for the petitioner inter alia contends that petitioner has been falsely implicated on the asking of his employer/manager. According to Annexure P-1, petitioner is a milk supplier and entered in the society at 8.45 a.m. and had come out at 8.58 a.m. According to the complainant, occurrence took place at 9.00 a.m., therefore, the presence of the petitioner in e-rikshaw of the complainant is doubtful.
